While Specific Informed Consent has been the established standard for obtaining consent for medical research for many years, it does not appear suitable for large-scale biobank and health data research. Thus, alternative forms of consent have been suggested, based on a variety of ethical background assumptions. This article identifies five main ethical perspectives at stake. Even though Tiered Consent, Dynamic Consent and Meta Consent are designed to the demands of the self-determination perspective as well as the perspective of research as (...) a public good, they are still also criticized from both perspectives. In addition, criticisms based on concerns of justice, participation and democratic deliberation, and relational concerns have been levelled at each of the models. As all of these perspectives have valid points to make, the task at hand lies in balancing these ethical perspectives. What constitutes an adequate balancing depends on contextual factors. These factors include digital infrastructure and digital literacy, data safety regulation, good scientific and clinical practice, transparent debates on ethically relevant features of research, social inequalities, anti-discrimination laws and practices, trust in health care institutions and recognition of patient preferences, and consensus on unethical research. We argue that the role of context in determining acceptable models of consent puts the ethical importance of models of consent into perspective. Since altering contextual factors can help to live up to the ethical concerns at stake in debates about models of consent, opting for such a shift of focus comes without ethical loss. (shrink)

The notion of the highest good used to occupy a primary role in ethical theorising, but has largely disappeared from the contemporary landscape. The notion was central to both Aristotle's and Kant's ethical theories, however--a surprising observation given that their approaches to ethics are commonly conceived as being diametrically opposed. The essays in this collection provide a comprehensive treatment of the highest good in Aristotle and Kant and show that, even though there are important differences in terms of content, there (...) are also important similarities in terms of the structural features of Aristotle's and Kant's value theories. By carefully analysing Aristotle's and Kant's theories of the highest good, a team of experts in the field shed light on their respective ethical theories and highlight the richness, complexity, and fruitfulness of the notion of the highest good. This chapter proceeds from the standard picture of the relation between intuitions and experimental philosophy: the alleged evidential role of intuitions about hypothetical cases, and experimental philosophy’s challenge to these judgments, based on their variation with philosophically irrelevant factors. I will survey some of the main defenses of this standard picture against the x-phi challenge, most of which fail. Concerning the most popular defense, the expertise defense, I will draw the bleak conclusion that intuitive expertise of the envisaged kind is (...) largely a myth. Next, I will consider the mischaracterization objection, which has mainly been developed by Deutsch and Cappelen on the basis of textual evidence: that philosophers do not appeal to intuitions as evidence for their case judgments, but instead argue for them. This would render the x-phi challenge mostly irrelevant, due to its focus on intuitions about hypothetical cases. I will then consider a few instructive replies to the mischaracterization objection, which are all unconvincing on further inspection. Finally, I will discuss some potential normative consequences of the mischaracterization objection, and I will argue that it recommends a shift away from the excessive focus on intuitions about cases in metaphilosophy and experimental philosophy, towards more work on the role of argumentation in the method of cases. More speculatively, I claim that philosophers should always argue for their case judgments, even if they have strong intuitions about them, because an argument-based methodology would be more transparent and philosophically fruitful than one that mainly relies on intuition. Eine philosophische Auseinandersetzung mit der Chemie ist so neu,1 daß die meisten Philosophen gegenwärtig Schwierigkeiten haben dürften, überhaupt eine thematische Verbindung zwischen beiden Fächern herstellen zu können, was auf ähnliche Weise übrigens auch auf Chemiker zutrifft. Daß dies nicht immer so war, wird sofort einsichtig, wenn man bedenkt, daß die chemische Frage nach der substantiellen Verschiedenartigkeit von Stoffen und ihren gegenseitigen Umwandlungsmöglichkeiten bereits zu den Grundfragen aller antiken Naturphilosophen gehörte. Es dürfte insbesondere dem theoretischen Ungenügen des Konzepts stofflicher Qualitäten nach (...) über 2000 Jahren zuzuschreiben sein, daß sich die neuzeitliche mechanische (Natur-)Philosophie gegen Ende des 17. Jahrhundert in nahezu konkurrenzloser Weise durchzusetzen vermochte, so daß jeder, der sich aufs moderne Philosophieren verstehen wollte, der Doktrin der primären (mechanischen) Qualitäten einschließlich der Reduktion jeder Veränderung auf Ortsveränderung anhängen mußte.2 Dieser Ansatz versprach auf einer theoretischen Ebene, mit einem Schlage alle Möglichkeiten stofflich substantieller Verschiedenheit und Veränderung in einen überschaubaren quantitativen Rahmen einzufangen. Diese Abwendung der Philosophie von den ursprünglichen chemischen Fragen beinhaltet drei für den vorliegenden Zusammenhang wichtige Kategorienverschiebungen. This article brings Leibniz' metaphysics down to earth. The long sought genesis of thinking is based on the organic nature. Leibniz' metaphysics is comprehensible as universal, because it links logic with the ontological fundamentals of the real. The paradox of individual substance is solvable. Herefore fact and concept of thinking are to be stretched towards acting, self-evolution as well as becoming self-conscious. So individual substance becomes the principle of organic nature, of becoming self-conscious, of historicity as well as the principle (...) of person — by the very structure. The opposites of belief and knowledge, of nature and history can be derived from the same principle. All human beings, all living beings are inseparably linked by their common structure. To approach the creation of artificial conscious systems systematically and to obtain certainty about the presence of phenomenal qualities (qualia) in these systems, we must first decipher the fundamental mechanism behind conscious processes. In achieving this goal, the conventional physicalist position exhibits obvious shortcomings in that it provides neither a plausible mechanism for the generation of qualia nor tangible demarcation criteria for conscious systems. Therefore, to remedy the deficiencies of the standard physicalist approach, a new theory for the understanding of (...) consciousness has been formulated. The aim of the paper is to present the cornerstones of this theory, to outline the conditions for conscious systems derived from the theory, and to address the implications of these conditions for the creation of robots that transcend the threshold of phenomenal awareness. In short, the theory is based on the proposition that the universe is permeated by a ubiquitous field of consciousness that can be equated with the zero-point field (ZPF) of quantum electrodynamics (QED). The ZPF, which is characterized by a spectrum of field modes, plays a crucial role in the edifice of modern physics. QED-based model calculations on cortical dynamics and empirical findings on the neural correlates of consciousness suggest that a physical system can only generate conscious states if it is capable of establishing resonant coupling to the ZPF, resulting in the amplification of selected field modes and the activation of the phenomenal qualities that are assumed to be associated with these modes. Thus, scientifically sound considerations support the conclusion that the crucial condition for generating conscious states lies in a system's capacity to tap into the phenomenal color palette inherent in the ZPF. The extent to which machine metaphors are used in synthetic biology is striking. These metaphors contain a specific perspective on organisms as well as on scientific and technological progress. Expressions such as “genetically engineered machine”, “genetic circuit”, and “platform organism”, taken from the realms of electronic engineering, car manufacturing, and information technology, highlight specific aspects of the functioning of living beings while at the same time hiding others, such as evolutionary change and interdependencies in ecosystems. Since these latter aspects are (...) relevant for, for example, risk evaluation of uncontained uses of synthetic organisms, it is ethically imperative to resist the thrust of machine metaphors in this respect. In addition, from the perspective of the machine metaphor viewing an entity as a moral agent or patient becomes dubious. If one were to regard living beings, including humans, as machines, it becomes difficult to justify ascriptions of moral status. Finally, the machine metaphor reinforces beliefs in the potential of synthetic biology to play a decisive role in solving societal problems, and downplays the role of alternative technological, and social and political measures. Two crucial questions, if unanswered, impede our understanding of Aristotle’s account of pleasure inenx.4-5: (1) What are the activities that pleasure is said to complete? (2) In virtue of what does pleasurealwaysaccompany these activities? The answers fall in place if we read Aristotle as responding to the Delian challenge that the finest, best and most pleasant are not united in one and the same thing (eni.8). I propose an ‘ethical’ reading ofenx.4 according to which the best activities in question are (...) those integral to the exercise of virtue. (shrink)

One way of coping with agreement of features in French is to perform two parallel computations, one in the free pregroup of syntactic types, the other in that of feature types. Technically speaking, this amounts to working in the direct product of two free pregroups.

I think that our concepts of past and future are so basic and so all-pervasive that I find it difficult to believe that anyone could even begin to make it appear plausible that one could dislodge them from their accustomed habitats. But Michael Dummett, in his paper Bringing about the past, while leaving no doubt about the fact that we are well-advised to leave the past where it belongs, arrives at the conclusion that under very special circumstances one might consider (...) it not completely impossible to regard a situation as one in which the past has been brought about. In spite of Dummett’s very sophisticated arguments I continue to have doubts about this. But before going into these doubts, I shall try to remind you of the substance of Dummett’s paper. (shrink)

This paper seeks to examine the relation between Kant’s aesthetic theory and the philosophy of Enlightenment. My study will focus on two central aspects from the Critique of Judgment: In connection with the Analytic of the Sublime, I will argue that Kant’s discussion of the concept enabled the development of the opinion that experiencing the specifically modern artistic beauty works as a means to equip us with an awareness of ourselves as beings equipped with reason. The second aspect I want (...) to discuss is that of the aesthetic ideas. I will show that in the Third Critique, the idea of experiencing artistic beauty functions as a compensation for the pressure of rationality that sets in together with modernity in the 18th century. Based on two of Ernst von Salomon’s literary documents on the Rural People’s Movement ["Landvolkbewegung"], this paper will trace the thinking of national revolutionary intellectuals and charismatic Landvolk leaders. Their clear rejection of National Socialism is just as evident as their retreat into a specific form of inner emigration.

We study the monoid of primitive recursive functions and investigate a onestep construction of a kind of exact completion, which resembles that of the familiar category of modest sets, except that the partial equivalence relations which serve as objects are recursively enumerable. As usual, these constructions involve the splitting of symmetric idempotents.

Grammar can be formulated as a kind of substructural propositional logic. In support of this claim, we survey bare Gentzen style deductive systems and two kinds of non-commutative linear logic: intuitionistic and compact bilinear logic. We also glance at their categorical refinements.

The old controversy between Legal Positivism and Natural Justice turns out to be fruitless, if we comprehend law as a phenomenon of culture. Then, law is neither mere will nor mere reason. Law, as it is understood in the Western tradition, is rather a contingent system of rules which guides decisions (politics, on the other hand, are guided by aims). Culture, as it is conceived since the age of Enlightenment, can be described as “what results from autonomy”. Law being a (...) valuable phenomenon of culture (Kulturgut), two questions arise. (1) Is there any need for law? It depends on society’s demand for liberty. (2) What does the law need? Law requires autonomy, i.e., the right to enjoy its own culture.Resumen:La antigua controversia entre el positivismo jurídico y la justicia natural resulta estéril si comprendemos al derecho como un fenómeno de la cultura. Consecuentemente, el derecho no es mera voluntad, ni tampoco razón pura. El derecho, como se entiende en la tradición occidental, es más bien un sistema contingente de reglas para la decisión (la política, en cambio, se guía por objetivos). La cultura, tal como es concebida des- de la época de la Ilustración, puede describirse como “aquello que es resultado de la autonomía”. Apres avoir établi et soumis à la revision les élements communs aux hypothèses de l’émergence connues jusqu’à présent, l’auteur tient compte de la possibilité de concilier l’émergence, considérée comme un processus particulier de la création dans la vie, avec le déterminisme. II cherche à rendre vraisemblable l’hypothèse que dans le monde vivant, à côté des lois préétablies telles que les a mises en lumière CI. Bernard, sont valides des lois « émergentes ». Le « réseau déterministe » grandit en quelque (...) sorte. C’est la possibilité de ces lois nouvelles, non celle de faits nullement déterminés, qui distingue ce « déterminisme » particulier. Within this paper we consider a model of Nash bargaining with incomplete information. In particular, we focus on fee games, which are a natural generalization of side payment games in the context of incomplete information. For a specific class of fee games we provide two axiomatic approaches in order to establish the Expected Contract Value, which is a version of the Nash bargaining solution.
